Please read these Terms and Conditions (“Terms”) carefully before using BirdseyeBYU.org (the “Site”), operated by the student organizers of BirdsEye (“BirdsEye,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you disagree with any part, you may not access the Site.
1. Relationship to Brigham Young University
BirdsEye is an independent, student-organized initiative. It is not a program, department, or officially recognized student organization of Brigham Young University (“BYU”), and it is not sponsored, funded, administered, or otherwise affiliated with BYU in any capacity. Our Disclaimer is incorporated into these Terms by reference.
2. Use of site
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:
- In any way that violates any applicable local, state, national, or international law or regulation;
- To transmit, or procure the sending of, advertising or promotional material without our prior written consent;
- To impersonate or attempt to impersonate BirdsEye, a BirdsEye organizer, Brigham Young University, or any other person or entity;
- In any way that infringes upon the rights of others, or that is unlawful, threatening, fraudulent, or harmful.
3. Submitted content
The Site may allow visitors to submit messages, stories, photographs, or other material (“Submitted Content”). By submitting Content, you represent that it is your original work, or that you hold the rights necessary to submit it, and that it does not violate any person’s or entity’s privacy, publicity, copyright, or other rights. We may decline to publish or remove Submitted Content at our sole discretion.
4. Intellectual property
The Site and its original content, features, and functionality—excluding Submitted Content and third-party or quoted material—remain the property of BirdsEye’s student organizers. Original content is protected by applicable copyright and other intellectual-property laws and may not be reproduced or used commercially without prior written permission.
5. Third-party and quoted content
The Site contains quotations, excerpts, or references to third-party sources. Their treatment, sourcing, and associated rights are addressed in our Disclaimer, incorporated into these Terms by reference.
6. Disclaimer of warranties
Use of the Site is at your sole risk. The Site is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
7. Limitation of liability
To the fullest extent permitted by law, BirdsEye, its student organizers, contributors, and members will not be liable for indirect, incidental, special, consequential, or punitive damages—including loss of profits, data, use, goodwill, or other intangible losses—arising from access to, use of, or inability to access or use the Site.
8. Governing law
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law provisions. Failure to enforce a right or provision is not a waiver. If a provision is held invalid or unenforceable, the remaining provisions remain in effect.
9. Changes to these terms
We may modify or replace these Terms at any time. Material changes will be reflected by an updated “Last Updated” date. Continued use after a change constitutes acceptance of the revised Terms.
